Buyers in India FAQ

This FAQ addresses common questions for buyers in India who purchase products from sellers in India on AWS Marketplace.

How do I identify products from sellers in India?

You can find the public listings from India-based sellers on the AWS Marketplace in India page. In the marketplace catalog, sellers have been given the guidance to explicitly state in the product description that the offer is being issued by their Indian entity or for buyers in India. We also advise contacting the seller to ensure the local availability. Products from sellers in India are exclusively available to buyers in India and are billed in Indian rupee (INR) with Goods and Services Tax (GST).

What currency will I be billed in when I purchase from sellers in India?

You are billed in Indian rupee (INR) by Amazon Web Services India Private Limited. You will be charged 18% Goods and Services Tax (GST) on your purchases. AWS India will facilitate issuance of tax invoices with the seller as the Seller on Record (SOR), and the GST collected will be remitted to the seller for deposit to tax authorities.

Can I purchase from both sellers in India and sellers in other locations?

Yes. Purchases from sellers in India are billed in INR by AWS India, while purchases from non-India based sellers or Amazon-affiliated entities continue to be billed in US dollars (USD) by AWS, Inc. based on your account location. You will receive separate invoices for each type of purchase.

How do private offers work for buyers in India?

Sellers can offer private offers to you in USD or INR. If you are on a private offer priced in INR, you will receive invoices in INR without any foreign exchange variability on the negotiated price. Private offers from sellers in India include applicable GST and are processed through AWS India Private Limited.

What happens to my existing AWS Marketplace subscriptions?

Existing subscriptions are from non-India based sellers or Amazon-affiliated entities and will continue to be facilitated by AWS, Inc. If a seller offers the same product via their Indian entity, you can switch to the India-based offer (with AWS India billing) but must cancel your current subscription from the non-India based seller.

What payment methods can I use for purchases from sellers in India?

You can pay only in Indian rupee (INR) using AMEX, MasterCard, RuPay, or Visa cards. Credit/debit cards must be tokenized per Reserve Bank of India regulations. NetBanking and UPI are not currently available. Wire transfers require separate India-based bank account details provided in your invoices.

How does invoicing work for purchases from sellers in India?

You receive separate invoices for purchases from sellers in India. AWS India Private Limited issues both a commercial invoice/statement listing all India-based seller purchases and separate tax invoices from each seller. These invoices are in INR and include GST details required for Indian tax compliance.

How do I track costs for purchases from sellers in India?

Purchases from sellers in India appear separately in your AWS billing and cost management tools with 'AWS India' in the invoicing entity field. You can use cost allocation tags and billing reports to track these INR expenses alongside your other AWS costs. AWS Cost Explorer and Cost and Usage Reports work the same way as before.

How do refunds work for purchases from sellers in India?

Refunds for purchases from sellers in India follow the standard AWS Marketplace refund process but are processed in INR through AWS India Private Limited. Contact AWS Marketplace support for assistance with refund requests.

What tax information do I need for purchases from sellers in India?

Your invoices from AWS India Private Limited include all necessary GST information for tax compliance. If you provide verified tax information in Tax Settings, tax invoices will contain QR codes and IRN numbers for claiming input tax credit. The same tax information used for AWS India cloud purchases applies to marketplace purchases.

What invoices will I receive for purchases from sellers in India?

For purchases from sellers in India, AWS India Private Limited will issue two types of invoices: (1) A commercial invoice/statement listing all purchases from India-based sellers, and (2) Separate tax invoices from each seller. If you have provided verified tax information, the tax invoices will contain QR codes and IRN numbers for claiming input tax credit.

How is GST type determined for my purchases?

GST type depends on location: If you and the seller are in the same state, CGST and SGST apply. If in different states, IGST applies. If either party is in a Special Economic Zone (SEZ), IGST applies regardless of state location.

Can I withhold tax on payments to AWS India for marketplace purchases?

No. You must not withhold taxes on payments to AWS India for purchases from India-based sellers. Under Section 194-O of the Income Tax Act, 1961, AWS India withholds taxes when passing payments to sellers, so customer withholding is not required.

Yes. AWS India uses separate bank accounts for cloud services and marketplace purchases. You must use the specific remittance information provided in each invoice type. Payments to incorrect accounts may be rejected and cause delays.

How do I use purchase orders for marketplace purchases through AWS India?

Existing purchase orders must have "AWS Marketplace blanket usage" selected and "AWS India" in the 'Bill From' section (or 'All' selected). Only properly configured purchase orders will appear on AWS India marketplace invoices.

How do Organizations and multiple accounts affect India marketplace purchases?

Invoices may be consolidated for accounts with identical tax settings within an Organization. Ensure tax information is current for all accounts via Tax Settings. If using a payer account structure, enable tax inheritance to apply payer account tax information to linked accounts.

How do India marketplace purchases appear in cost management tools?

AWS Cost Explorer and Cost and Usage Reports work the same way. India marketplace transactions show 'AWS Marketplace' as billing entity, seller name in legal entity field, and 'AWS India' in invoicing entity field (vs 'AWS, Inc.' for non-India sellers).

What happens if I change my account location from India to non-India?

If you change your tax/billing address from India while having active purchases from India-based sellers, you must either: (1) revert your information back to India to continue with India-based sellers, or (2) select alternate non-India sellers as India-based offerings will be terminated due to location ineligibility.

What is the difference between B2B and B2C buyers in India?

The classification of a transaction as business-to-business (B2B) or business-to-consumer (B2C) depends on whether you have provided valid GST details in your AWS India profile. If you provide GST details, the transaction is treated as B2B. If you don't provide GST details, the transaction is treated as B2C. This classification affects the tax invoice requirements and whether a seller's signature is required on the invoice.

What happens if I delete or have an invalid GSTIN?

If you delete your GSTIN or if your GSTIN becomes invalid, your transactions will be treated as B2C instead of B2B. This means tax invoices will require the seller's signature for compliance. Additionally, you may not be able to claim input tax credit without valid GST details. Make sure to keep your GSTIN information current in your AWS India Tax Settings to maintain B2B status and proper tax treatment.

How do I get support for purchases from sellers in India?

You can use the standard AWS Marketplace support processes for issues related to purchases from sellers in India. For tax-related questions specific to India, consult with your tax advisor regarding GST and TDS requirements.
